This Privacy Policy applies to both the Life Engineer.ai(the Site) and the Life Engineer Application (the App), and its associated subdomains (collectively, our “Service”) alongside our application, Life Engineer. Country: where Life Engineer or the owners/founders of Life Engineer are based, in this case is Canada

Customer: refers to the company, organization or person that signs up to use the Life Engineer Service to manage the relationships with your consumers or service users.

Service: refers to the service provided by Life Engineer as described in the relative terms and conditions and on this platform.

Third-party service: refers to advertisers, contest sponsors, promotional and marketing partners, and others who provide our content or whose products or services we think may interest you.

You: a person or entity that is registered with Life Engineer to use the Services.

When the legal basis for us processing your personal data is that you have provided your consent to that processing, you may withdraw your consent at any time. If you withdraw your consent, it will not make processing which we completed before you withdrew your consent unlawful.

Who We Share Personal Data With
Employees
We may disclose user data to any member of our organization who reasonably needs access to user data to achieve the purposes set out in this Privacy Policy.

We may also disclose personal and non-personal information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate in order to respond to claims, legal process (including subpoenas), to protect our rights and interests or those of a third party, the safety of the public or any person, to prevent or stop any illegal, unethical, or legally actionable activity, or to otherwise comply with applicable court orders, laws, rules and regulations.

Third parties will not be able to access user data beyond what is reasonably necessary to achieve the given purpose.

We will not sell or share your data with other third parties, except in the following cases:

1) If the law requires it;
2) If it is required for any legal proceeding;
3) To prove or protect our legal rights;
4) To buyers or potential buyers of this company in the event that we seek to sell the company.

How Long We Store Personal Data
We keep your information only so long as we need it to provide our Services to you and fulfill the purposes described in this policy. This is also the case for anyone that we share your information with and who carries out services on our behalf. When we no longer need to use your information and there is no need for us to keep it to comply with our legal or regulatory obligations, or when you delete your account, we’ll either remove it from our systems or depersonalize it so that we can't identify you. 

 How We Protect Your Personal Data

We take precautions to protect the security of your information. We have physical, electronic, and managerial procedures to help safeguard, prevent unauthorized access, maintain data security, and correctly use your information including:

1) Encryption: All personal data and sensitive information will be encrypted both in transit and at rest.

2) Confidentiality: Employees will be required to sign confidentiality agreements, and access to user data will be strictly limited to authorized personnel.

3) Multi-Factor Authentication (MFA): Will be enforced for employees accessing sensitive data.

However, neither people nor security systems are foolproof, including encryption systems. In addition, people can commit intentional crimes, make mistakes or fail to follow policies. Therefore, while we use reasonable efforts to protect your personal information, we cannot guarantee its absolute security. If applicable law imposes any non-disclaimable duty to protect your personal information, you agree that intentional misconduct will be the standards used to measure our compliance with that duty.

While we take all reasonable precautions to ensure that user data is secure and that users are protected, there always remains the risk of harm. The Internet as a whole can be insecure at times and therefore we are unable to guarantee the security of user data beyond what is reasonably practical.

International Data Transfers

Life Engineer
is incorporated in Canada. Information collected via our website or app, through direct interactions with you, or from use of our help services may be transferred from time to time to our offices or personnel, or to third parties, located throughout the world, and may be viewed and hosted anywhere in the world, including countries that may not have laws of general applicability regulating the use and transfer of such data. To the fullest extent allowed by applicable law, by using any of the above, you voluntarily consent to the trans-border transfer and hosting of such information.

When we transfer user personal data we will protect that data as described in this Privacy Policy and comply with applicable legal requirements for transferring personal data internationally.

If you are located in the United Kingdom or the European Union, we will only transfer your personal data if:
1) The country your personal data is being transferred to has been deemed to have adequate data protection by the European Commission or, if you are in the United Kingdom, by the United Kingdom adequacy regulations;

Can I update or correct my information?

The rights you have to request updates or corrections to the information Life Engineer collects depend on your relationship with Life Engineer. Personnel may update or correct their information as detailed in our internal company employment policies.

Customers have the right to request the restriction of certain uses and disclosures of personally identifiable information as follows. You can contact us in order to (1) update or correct your personally identifiable information, (2) change your preferences with respect to communications and other information you receive from us, or (3) delete the personally identifiable information maintained about you on our systems (subject to the following paragraph), by cancelling your account. Such updates, corrections, changes and deletions will have no effect on other information that we maintain, or information that we have provided to third parties in accordance with this Privacy Policy prior to such update, correction, change or deletion. To protect your privacy and security, we may take reasonable steps (such as requesting a unique password) to verify your identity before granting you profile access or making corrections. You are responsible for maintaining the secrecy of your unique password and account information at all times.

You should be aware that it is not technologically possible to remove each and every record of the information you have provided to us from our system. The need to back up our systems to protect information from inadvertent loss means that a copy of your information may exist in a non-erasable form that will be difficult or impossible for us to locate. Promptly after receiving your request, all personal information stored in databases we actively use, and other readily searchable media will be updated, corrected, changed or deleted, as appropriate, as soon as and to the extent reasonably and technically practicable.

If you are an end user and wish to update, delete, or receive any information we have about you, you may do so by contacting the organization of which you are a customer.

Personnel

If you are a Life Engineer worker or applicant, we collect information you voluntarily provide to us. We use the information collected for Human Resources purposes in order to administer benefits to workers and screen applicants.You may contact us in order to (1) update or correct your information, (2) change your preferences with respect to communications and other information you receive from us, or (3) receive a record of the information we have relating to you. Such updates, corrections, changes and deletions will have no effect on other information that we maintain, or information that we have provided to third parties in accordance with this Privacy Policy prior to such update, correction, change or deletion

Sale of Business

We reserve the right to transfer information to a third party in the event of a sale, merger or other transfer of all or substantially all of the assets of Life Engineer  or any of its Corporate Affiliates (as defined herein), or that portion of Life Engineer  or any of its Corporate Affiliates to which the Service relates, or in the event that we discontinue our business or file a petition or have filed against us a petition in bankruptcy, reorganization or similar proceeding, provided that the third party agrees to adhere to the terms of this Privacy Policy.

Affiliates

We may disclose information (including personal information) about you to our Corporate Affiliates. For purposes of this Privacy Policy, "Corporate Affiliate" means any person or entity which directly or indirectly controls, is controlled by or is under common control with Life Engineer, whether by ownership or otherwise. Any information relating to you that we provide to our Corporate Affiliates will be treated by those Corporate Affiliates in accordance with the terms of this Privacy Policy.

Governing Law

This Privacy Policy is governed by the laws of Canada without regard to its conflict of laws provision. You consent to the exclusive jurisdiction of the courts in connection with any action ordispute arising between the parties under or in connection with this Privacy Policy except for those individuals who may have rights to make claims under Privacy Shield, or the Swiss-US framework.

The laws of Canada, excluding its conflicts of law rules, shall govern this Agreement and your use of the website or app. Your use of the website or app may also be subject to other local, state, national, or international laws.

By using Life Engineer or contacting us directly, you signify your acceptance of this Privacy Policy. If you do not agree to this Privacy Policy, you should not engage with our website or app, or use our services. Continued use of the website or app, direct engagement with us, or following the posting of changes to this Privacy Policy that do not significantly affect the use or disclosure of your personal information will mean that you accept those changes.
Cookie Policy
A cookie is a small file, stored on a user's hard drive by a website. Its purpose is to collect data relating to the user's browsing habits. You can choose to be notified each time a cookie is transmitted. You can also choose to disable cookies entirely in your internet browser, but this may decrease the quality of your user experience.We use the following types of cookies on our Site:

Disabling a cookie or category of cookie does not delete the cookie from your browser, you will need to do this yourself from within your browser, you should visit your browser's help menu for more information.

Children
The minimum age to use our Service is 16 years of age. We do not knowingly collect or use personal data from children under 16 years of age. If we learn that we have collected personal data from a child under 16 years of age, the personal data will be deleted as soon as possible. If a child under 16 years of age has provided us with personal data their parent or guardian may contact support@lifeengineer.ai.

Changes To Our Privacy Policy
We may change our Service and policies, and we may need to make changes to this Privacy Policy so that they accurately reflect our Service and policies. Unless otherwise required by law, we will notify you (for example, through our Service) before we make changes to this Privacy Policy and give you an opportunity to review them before they go into effect. Then, if you continue to use the Service, you will be bound by the updated Privacy Policy. If you do not want to agree to this or any updated Privacy Policy, you can delete your account.

We may display, include or make available third-party content (including data, information, applications and other products services) or provide links to third-party websites or services ("Third- Party Services").You acknowledge and agree that Life Engineer shall not be responsible for any Third-Party Services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect thereof. Life Engineer does not assume and shall not have any liability or responsibility to you or any other person or entity for any Third-Party Services.Third-Party Services and links thereto are provided solely as a convenience to you and you access and use them entirely at your own risk and subject to such third parties' terms and conditions.

Information about General Data Protection Regulation (GDPR)

For users in the European Union, we adhere to the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, known as the General Data Protection Regulation (the "GDPR"). For users in the United Kingdom, we adhere to the GDPR as enshrined in the Data Protection Act 2018.We have not appointed a Data Protection Officer as we do not fall within the categories of controllers and processors required to appoint a Data Protection Officer under Article 37 of the GDPR.
Do Not Track Notice
Do Not Track ("DNT") is a privacy preference that you can set in certain web browsers. We do not respond to browser-initiated DNT signals. We are not responsible for and cannot guarantee how any third parties who interact with our Site and your data will respond to DNT signals.

This Privacy Notice supplements the lifeengineer.ai Privacy Policy and applies solely to California consumers who visit lifeengineer.ai. Any terms defined in the California Consumer Privacy Act of 2018 (“CCPA”) have the same meaning when used in this Privacy Notice.

Access to Specific Information and Data Portability Rights
You have the right to request that lifeengineer.ai disclose to you certain information about our collection and use of your personal information in the past 12 months. Once we receive and confirm your verifiable consumer request (see the Exercising Your Access and Deletion Rights section below), we will disclose to you:

The categories of sources from which we collected personal information about you;
Our business or commercial purpose for collecting or selling personal information;
The categories of third parties with whom we share personal information;

Deletion Request Rights
You have the right to request that we delete any of your personal information that we collected and retained, subject to certain exceptions. Once we have received and confirmed your verifiable consumer request, we will delete, and direct any of our service providers to delete, your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service providers to:

1) Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you;

4) Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law;
5) Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.);
6) Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when deletion of the information is likely to render impossible or seriously impair the research’s achievement, if you previously provided informed consent;
7) Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;
8) Comply with a legal obligation;
9) Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
Exercising Your Access and Deletion Rights
To exercise your access and deletion rights described above, please submit a verifiable consumer request to us at support@lifeengineer.ai.

You may only make a verifiable consumer request for access twice within a 12-month period. The verifiable consumer request must:

1) Provide enough information for us to reasonably verify you are the person about whom we collected personal information or an authorized representative;

2) Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. You are not required to make an account with us to make a verifiable consumer request. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Response Timing and Format
We endeavor to respond to a verifiable consumer request as soon as possible and we will deliver our written response electronically.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination
You have the right to not be discriminated against in pricing and services because you exercise any of your CCPA rights. Unless permitted by the CCPA, we will not use whether or not you have exercised your CCPA rights to:

1) Deny you goods or services;
2) Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
3) Provide you a different level or quality of goods or services; or
4) Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

We may amend this Privacy Notice from time to time to maintain compliance with the law and to reflect any changes to our data collection process. We recommend you check this Privacy Notice from time to time to ensure you are aware of any changes. If necessary, we may notify you by email of changes to this Privacy Notice.
